Bullying & Equal Pay

Did you know there is a direct link in many cases of equal pay issues with bullying, harassment and/or victimisation?

It may be used as another tool to bully an employee or in some cases, for making a complaint about being bullied.

Any person who suffers from bullying should check whether they are paid equally as, although legal remedy is difficult in bullying cases, it is available in all situations for equal pay. Which UK law would be applicable would depend on the individual circumstances but this may give targets one angle that can be used to good effect - and targets need to grasp hold of anything that will help in their fight!

From research, the problem could affect 40% of people who are bullied, yet many do not think about or do not know how to find out if it affects them. Finding out is now much easier since the introduction of the equal pay questionnaire to find out a comparators pay and related benefits, without having to make a tribunal claim. If there is no problem, then you have lost nothing, but if there is.....

The pages in this section will help you work your way through the process of an equal pay case. Broadly, the steps are as follows:

    1. Identify a suitable comparator
    2. Find out if you are paid the same
    3. If you are not, look at explanations could there be and whether you are satisfied that this explains the difference
    4. If you are not satisfied, make a formal complaint to your employer via their grievance process
    5. If you are still not satisfied or a grievance was not possible, proceed to tribunal within the relevant time limits.
